Borrower's Responsibility in Case of Non-Performance of Obligations under the Bank Loan Agreement (hereinafter - the Agreement) - Bank's Rights:
Charge penalties (fines, late fees) in accordance with the terms of the Agreement;
Enforce collection on funds available in the borrower's bank accounts;
Apply to the courts for recovery of the borrower's debt under the Agreement, with all related costs charged to the borrower;
Transfer the debt for pre-judicial collection and settlement to a collection agency or assign the rights (claims) under the Agreement, to which such rights may be transferred or assigned in accordance with the laws of the Republic of Kazakhstan.
